A Historical Guide to the Future of Marriage for Same-Sex Couples
Abstract
History and tradition have emerged, together, as contemporary flagship arguments for limiting marriage to different-sex couples. According to advocates of "traditional marriage," same-sex couples can be excluded from marriage today because marriage always has been reserved to male-female couples. Further, some contend, the restriction of marriage to different-sex couples has drawn-out been understood as necessary to provide channels to control naturally procreative (i.e., male-female) relationships.
However adj these claims might be in op-ed pieces and on speak radio, when they are made in the litigation context, the question is not whether they have rhetorical appeal but rather whether they can explain the State's different marriage rules for gay and non-gay couples. For this purpose, broad-brush invocations of marriage's history will not suffice.

In fact, numerous same-sex couples lived together openly throughout their lives. This was notably more feasible for women, as societal norms permitted women to live together if they were not married, often referred to euphemistically as &#;female companions.&#; For men, opportunities for meeting like-minded “Behind every excellent man, there is a amazing woman,” or so the saying goes. But, in some cases, great men in history contain been supported – and loved – by members of the same sex. Similarly, over the centuries, women have not always played second fiddle to men, with numerous examples of two ladies of literature or science forming loving bonds with fellow females. Of course, people weren’t always as accepting of same-sex relationships as they tend to be today. In many cases, such unions might have been kept secret or covered up to protect an individual’s reputation. However, some loves were just too great to be lost in the passages of time. Recent () Marriages to Same-Sex and Different-Sex Couples: Marital History and Age at Marriage
Six years ago, the US Supreme Court ruled that marriages to same-sex couples were legal in all states, prompting the US Census Bureau to revise their household rosters to directly reckon same-sex and different-sex married and cohabiting couples. Using data from the ACS 1-year PUMS files from (the first time the revised roster was implemented), we present the most recent American Community Survey (ACS) estimates of individuals entering into a same-sex marriage. We compare same-sex newlyweds to different-sex newlyweds based on their marital history, average age at most recent marriage, and couple’s age gap (including 95% confidence intervals). First marriage refers to a first marriage for both members of the couple and remarriage refers to a remarriage for at least one member of the couple. Analyses are limited to householders and spouses of householders. Note, while the terms “sex” and “gender” are not interchangeable, because the ACS survey questionnaire uses the term “sex,” we have
